1. Acceptance of Terms

By downloading, installing, or using the Life is Live application ("the App"), you agree to be bound by these Terms & Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Life is Live. If you do not agree with any part of these Terms, you must not download, install, or use the App. Your continued use of the App following any updates to these Terms constitutes your acceptance of the revised Terms.

2. Eligibility & Age Requirements

You must be at least 13 years of age (or the minimum age required in your jurisdiction, such as 16 in the EU) to create an account and use the App. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the App, you represent and warrant that you meet the applicable age requirements. We reserve the right to request proof of age and to terminate accounts that violate age requirements.

3. Account Registration

To access certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at [email protected] if you suspect any unauthorized access to your account. We reserve the right to refuse registration, suspend, or terminate accounts at our discretion.

4. Description of Service

Life is Live is a live entertainment platform that provides the following services:

  • Solo live streaming — broadcast to your audience in HD quality with real-time interaction
  • Battle streaming — two or more streamers compete in real-time while audiences cheer, vote, and send gifts
  • Party streaming — group rooms where multiple participants join, hang out, and play games together live
  • In-app games — play solo or with other users in games designed for live entertainment
  • Virtual gifting — supporters can purchase and send virtual gifts, including unique collectible items, to streamers as a form of support

5. User Conduct

You agree to use the App in compliance with all applicable laws, regulations, and our Community Guidelines. The following activities are strictly prohibited and may result in immediate account suspension or termination:

  • Broadcasting or sharing illegal, harmful, hateful, violent, sexually explicit, or otherwise offensive content
  • Harassing, threatening, bullying, stalking, or intimidating other users
  • Impersonating other users, public figures, or entities
  • Attempting to exploit, hack, reverse-engineer, decompile, or disassemble the App or its systems
  • Using automated systems, bots, scripts, or third-party tools to interact with the service
  • Engaging in fraudulent gift transactions, money laundering, or any form of financial fraud
  • Soliciting personal information from minors or engaging in any activity that exploits children

6. In-App Purchases & Virtual Items

The App offers in-app purchases through the Apple App Store and Google Play Store. By making a purchase, you agree to the following:

  • All in-app purchases are processed by Apple (for iOS) or Google (for Android) through their respective billing systems. Your purchase is subject to the payment terms of the applicable platform.
  • Virtual gifts, coins, and other virtual items purchased within the App are digital items with no real-world monetary value outside the platform. They are licensed to you, not sold, and remain our property.
  • Virtual items cannot be exchanged, transferred, or redeemed for real currency, goods, or services outside the App, except through our official creator payout program where applicable.
  • Prices for virtual items are displayed in your local currency within the App. We reserve the right to modify pricing at any time. Changes will not affect items already purchased.
  • You acknowledge that virtual items may be modified, replaced, or removed as part of updates to the App, and you will not be entitled to compensation for such changes.

7. Subscriptions & Auto-Renewal

The App may offer subscription-based services. If you subscribe, the following terms apply:

  • Subscriptions automatically renew at the end of each billing period (weekly, monthly, or annually, depending on your selected plan) unless cancelled at least 24 hours before the end of the current period.
  • Payment will be charged to your Apple ID or Google Play account at confirmation of purchase and at the start of each renewal period.
  • You can manage and cancel your subscription at any time through your device's subscription settings: on iOS, go to Settings > Apple ID > Subscriptions; on Android, go to Google Play Store > Subscriptions.
  • Cancellation takes effect at the end of the current billing period. You will retain access to subscription benefits until the period expires.
  • Free trial periods, if offered, will automatically convert to a paid subscription at the end of the trial unless cancelled at least 24 hours before the trial expires.
  • We reserve the right to change subscription fees upon reasonable notice. Price changes will take effect at the start of the next billing cycle after notice is provided.

8. Refund Policy

All purchases are processed through the Apple App Store or Google Play Store, and refund policies are governed by the respective platform. To request a refund: for iOS purchases, visit Apple Support at https://support.apple.com/en-us/HT204084 or use the "Report a Problem" feature; for Android purchases, visit Google Play Support at https://support.google.com/googleplay/answer/2479637. We do not process refunds directly. If you believe a purchase was made in error or without authorization, please contact the respective platform and our support team at [email protected]. Refund eligibility is determined by the applicable platform's refund policies.

9. Streaming Content & Licensing

You retain ownership of original content you create and stream on Life is Live. By streaming or uploading content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and store your content for the purpose of operating, promoting, and improving the service. This license continues until you delete the content or your account, except where content has been shared with other users or is required for legal compliance. We reserve the right to remove, disable, or restrict access to any content that violates these Terms, our Community Guidelines, or applicable law, without prior notice.

10. Intellectual Property

The App, including its design, source code, features, logos, trademarks, and all associated intellectual property, is owned by Life is Live and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on any part of the App without our prior written consent. All user-generated content remains the property of the respective users, subject to the license granted in Section 9.

11. Account Termination & Deletion

Regarding account termination and deletion:

  • We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or our Community Guidelines, or for any conduct that we determine is harmful to other users, us, or third parties.
  • Upon termination, your right to use the App ceases immediately. Any virtual gifts, coins, or virtual currency in your account may be forfeited and will not be refunded.
  • You may delete your account at any time through the App by going to Settings > Account > Delete Account. Account deletion is permanent and cannot be undone. Please cancel any active subscriptions through your device settings before deleting your account.
  • After deletion, your personal data will be removed in accordance with our Privacy Policy. Some data may be retained as required by law or for legitimate business purposes (such as fraud prevention and financial records).

12. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIFE IS LIVE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (C) CONDUCT OF ANY THIRD PARTY ON THE APP; OR (D) ANY OTHER MATTER RELATING TO THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless Life is Live, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or related to: your use of the App; your violation of these Terms; your violation of any rights of another party; or any content you create, stream, or share through the App.

15. Dispute Resolution & Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall first be attempted to be resolved through informal negotiation by contacting us at [email protected]. If the dispute is not resolved within 30 days, it shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in English. You agree to waive any right to a jury trial and to participate in a class action lawsuit or class-wide arbitration. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction. This arbitration provision does not apply where prohibited by applicable law.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence. Any legal proceedings that are not subject to arbitration shall be brought exclusively in the courts located in Delaware, USA.

17. Third-Party Services

The App may contain links to or integrations with third-party websites, services, or applications, including the Apple App Store, Google Play Store, payment processors, and social media platforms. We are not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with third-party services are governed by their respective terms and policies. We encourage you to review the terms and privacy policies of any third-party service you access through the App.

18. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will: update the "Last updated" date at the top of these Terms; provide notice through the App at least 30 days before the new terms take effect; and for significant changes, request your explicit acceptance. If you do not agree to the revised Terms, you must stop using the App. Your continued use of the App after the updated Terms take effect constitutes your acceptance of the changes.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
